This privacy policy (“Privacy Policy”) covers the data collection and processing activities of Crispy Cones, LLC (hereinafter “Crispy Cones,” “we,” “our,” or “us”). This page is intended to act as a Notice at Collection (where required by applicable law) and includes information such as the categories of personally identifiable information (“Personal Information”) we collect, the purposes for which we use it, how it will be shared, and more. It applies when you access and/or use the Crispy Cones website (https://www.thecrispycones.com/), the Crispy Cones mobile application, or any other site or application where this Privacy Policy is posted (the “Sites”), or if you avail yourself of any of our services, including by visit any of our locations, purchasing our products, or communicating with us in any matter (collectively our “Offerings”). The Sites and our Offerings are hereinafter collectively referred to as our “Services.”
Please carefully read this Privacy Policy so that you will fully understand how your Personal Information will be treated. From time to time, we may change this Privacy Policy – please see the “CHANGES” section below for more.
By accessing, using, or availing yourself of our Services, you are consenting (where allowed by applicable law) to the practices described in this Privacy Policy as well as our Terms of Service, incorporated here by reference.
CATEGORIES OF INFORMATION WE COLLECT
Typically, the Personal Information we receive comes when you interact with us directly. We collect Personal Information that you voluntarily provide when you use or access the Services, including when you purchase products or services, contact us with inquiries or product / service feedback, or create an account with us. We may also automatically receive certain information about you when you interact with our Services.
This information may include your name, email address, billing or shipping address, telephone number, payment information, and/or details relating to your purchase. We may also process any information you choose to provide us with in applicable communications, including those regarding our Services or feedback on our Services. We may also collect information such as your email or other contact information for marketing purposes. When you choose to create an account with us (where applicable) or participate in other services, programs and/or promotions, you may also provide us or third parties we work with information such as an email or physical address, phone number, birthdate, account credentials, and/or any other information that we request or collect in order to effectively administer those accounts and programs. We may also process any information you choose to provide us with in connection with those accounts and programs, including saved favorites, account notes or entries, event information, and more.
If you participate in our SMS Messaging program (“SMS Messaging Program”), we may collect Personal Information such as the content of any text message responses to us, any user or screen name you may provide, and/or your opt-out preferences. We may also collect Personal Information such as device availability for messaging, messaging history, your carrier, the country associated with the phone, message delivery status, and/or message error codes as part of the SMS Messaging Program. Please see our Terms of Service for further details regarding use of the SMS Messaging Program. Personal Information obtained through the SMS Messaging Program will not be shared, sold, or rented to any third parties for their marketing purposes.
If you are accessing applicable Services from a computer or a mobile device, you may be asked to share your geolocation information with us. If you agree to the collection of location data, in most cases, you will be able to turn off such data collection at any time, including by accessing the privacy settings of your computer, browser, or mobile device.
If you apply for a job or business relationship with us (where applicable) you may be asked to provide more detailed Personal Information which will be specified at the point of collection and that we will use to evaluate your qualifications for applicable openings or positions. If you as an individual reach out to us in a business capacity, we may also process any information you choose to provide us with (such as your name and contact information).
We may automatically receive certain information about you when you interact with our Services. This may include IP address, browser type, information about your operating system or network, internet browsing data such as what websites, ads, or search terms referred you to our website, how you engage with our Sites, marketing, or communications, your transaction history, and your general location. This information helps us understand how you use our Services, particularly our Sites, and gives us the feedback we need to improve them. Crispy Cones’s website is hosted by Squarespace, and Squarespace may choose to use its own cookies to collect data. Crispy Cones is not responsible for these cookies, but they may be viewed here: The cookies Squarespace uses. Squarespace may also use automated decision-making to conduct risk and fraud screening.
Crispy Cones is not responsible for any Personal Information collected by third parties’ cookies from sites other than Crispy Cones’s own.
Sensitive Personal Information
We may collect sensitive Personal Information. What is considered “sensitive” Personal Information depends on applicable law(s) but may include your precise geolocation, account credentials, information about your religious beliefs, health data or genetic data, and more. We or third parties we work with may process information such as account information and passwords or your geolocation to provide the Services that you have requested. We do not disclose or collect your sensitive Personal Information for any other purposes, nor do we collect or process it with the purpose of inferring characteristics about you or other consumers. How to limit and/or opt-out of processing of sensitive Personal Information, if applicable, is addressed below in the “YOUR PRIVACY RIGHTS” section.
USE OF YOUR PERSONAL INFORMATION
We use Personal Information to provide and improve our Services to you and other consumers. In so doing, we anticipate using information in any of the following manners:

Crispy Cones is not responsible for any Personal Information collected by third parties from sites or services other than Crispy Cones’ own.
Where you have an account with us, some of the information collected for the above purposes may be tied to that account. We may link information we have collected, including your contact information, transaction history, preferences, etc., to your account to provide us with analytics, improve our services, and provide you with more personalized experiences.
Information Retention
We strive to retain Personal Information only as long as is reasonably necessary to fulfill the purposes for which it is collected, including the fulfillment of purchases, consumer services, and/or our own internal statistics and functions.
SHARING YOUR PERSONAL INFORMATION
Personal Information we process may be shared with and/or stored by third parties to help us provide the Services and/or use your Personal Information as described above. For example, we may provide some of your Personal Information to a third-party delivery service in order to have your order delivered. Or, as you go through checkout, this site may auto-complete your shipping and billing address by sharing what you type with the Google Places API and returning suggestions to you to improve your checkout experience. We may also share information with Squarespace, our hosting provider for this website, so that they can provide website services to us. Crispy Cones does not sell Personal Information to third parties for monetary consideration. Personal Information obtained through the SMS Messaging Program will not be shared, sold, or rented to any third parties for their marketing purposes.
Right to Opt-Out
We do not sell Personal Information for monetary consideration. Crispy Cones is not responsible for these third-party sites. You visit them at your own risk, and we encourage you to read their privacy policies. For example, you may use a third-party payment option to pay for orders. The privacy policy and practices of that third party payment provider will apply to your Personal Information.
In addition, your browser may already contain cookies placed by third-party sites, including various social media platforms. Crispy Cones is not responsible for the Personal Information such cookies may collect or what they may do with it. Nor is Crispy Cones responsible for any Personal Information collected by third parties’ cookies from sites other than Crispy Cones’ own.

We strive to process your Personal Information in accordance with applicable data privacy laws, which create a variety of privacy rights for covered consumers. These rights may include:

DO NOT TRACK
Some web browsers incorporate a “Do Not Track” or similar feature that signals to websites that you visit that you do not want to have your online activity tracked. PRIVACY FOR CHILDREN
Our Services are not directed to or intended for use by children or minors as defined by applicable law (hereinafter “Minors”). We do not knowingly sell or share information from Minors. If it is determined that Personal Information has been inadvertently collected on any Minors without the necessary consent, we will immediately take steps to ensure that such Personal Information is deleted, or, in the alternative, that the necessary consent is obtained for the use and storage of such Personal Information. We reserve the right to update this Privacy Policy from time to time to reflect, for example, changes to our practices or for other operational, legal, or regulatory reasons.
